Liability Waiver, Assumption of Risk & Release of Claims

1. ASSUMPTION OF RISK
I understand that participation in activities at The Remix Room involves physical activity, movement, paint use, loud music, flashing or low lighting, and high-energy environments. These activities may include, but are not limited to:Slips, trips, and fallsPaint splatter, drips, spills, and oversprayPaint entering eyes, mouth, nose, ears, or contact lensesSkin irritation or allergic reactionsStains or damage to clothing, shoes, jewelry, phones, watches, eyewear, bags, or other personal itemsBroken, lost, or damaged personal propertyCollisions with walls, floors, fixtures, equipment, or other participantsMinor or serious injuries including bruises, strains, sprains, scrapes, or other physical harmExposure to loud music, flashing lights, and sensory stimulationI voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation.

2. RELEASE OF LIABILITY

In consideration for being permitted to participate, I release, waive, discharge, and hold harmless The Remix Room, its owners, officers, employees, contractors, volunteers, and affiliates from any and all claims, demands, actions, or causes of action, including those arising from negligence, to the fullest extent permitted by law.This release applies to claims for personal injury, property damage, emotional distress, or death, whether known or unknown, arising from participation or presence on the premises.

3. PAINT & MATERIAL DISCLOSURE

I understand that paints and materials used may contain pigments, binders, or additives that could cause skin, eye, or allergic reactions. I acknowledge that it is my responsibility to inform staff of any known allergies, sensitivities, or medical conditions prior to participation.I voluntarily assume all risks related to contact with paints and materials used during the experience.

4. PERSONAL PROPERTY DISCLAIMER

I understand that paint is permanent and that damage to personal belongings is likely. I accept full responsibility for any loss, damage, or staining of personal items and agree that The Remix Room is not responsible for replacement or repair of any personal property.

5. MEDICAL ACKNOWLEDGMENT

I confirm that I am physically and mentally able to participate and do not have any condition that would make participation unsafe. I understand that The Remix Room does not provide medical treatment and that I am responsible for any medical care required as a result of participation.

6. INTOXICATION & BEHAVIOR POLICY

I confirm that I am not under the influence of drugs or alcohol to a degree that would impair safe participation. The Remix Room reserves the right to deny participation or remove any participant who appears impaired or behaves unsafely, without refund.

7. ACTIONS OF OTHER PARTICIPANTS

I understand that other participants may act unpredictably. I voluntarily assume all risks related to the actions, behavior, or negligence of other participants.

8. EMOTIONAL & SENSORY ACKNOWLEDGMENT

I acknowledge that participation may involve loud music, lighting effects, physical activity, close proximity to others, and sensory stimulation that could cause discomfort, anxiety, or emotional distress. I voluntarily assume these risks and waive any claims related to emotional or sensory effects.

9. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless The Remix Room from any claims, damages, losses, or legal expenses (including attorney’s fees) arising from my participation or actions, including claims brought by third parties.

10. FACILITY & UNFORESEEN CONDITIONS

I understand that The Remix Room is an industrial-style environment that may include concrete floors, metal surfaces, lighting equipment, electrical components, and fixtures. I accept the facility as-is and assume all risks associated with the condition of the premises

.11. TIME LIMIT ON CLAIMS

Any claim arising from participation must be brought within one (1) year of the date of the activity, to the fullest extent permitted by law.1

2. SEVERABILITY

If any portion of this agreement is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.

13. GOVERNING LAW

This agreement shall be governed by the laws of the state in which The Remix Room operates.

14. ELECTRONIC SIGNATURE & BINDING AGREEMENT

I understand that checking a box, typing my name, or submitting this waiver electronically constitutes a legally binding signature equivalent to a handwritten signature.
